Admissibility Appeals @ IAD

Canadian Permanent Residents (PR) and Foreign Nationals (FN) can become inadmissible to Canada for certain reasons. The factors that can make a PR or FN are enumerated in section 34-42 of IRPA. These factors are:

  1. Security (s 34)
  2. Human or International Rights violations (s 35)
  3. Serious Criminality (s 36)
  4. Organized Criminality (s 37)
  5. Health reasons (s 39)
  6. Financials (s39)
  7. Misrepresentation (s 40)
  8. Non-compliance with IRPA (s 41)
  9. Inadmissible Family member (s 42)

Inadmissibility can be challenged at Immigration Appeal Division of IRB. Only Level 3 Immigration Consultant (RCIC-IRB), Canadian Lawyers and Notaries can represent clients at IAD of IRB. Due to complicated nature of proceedings and application of law, it is very difficult for an applicant to represent himself without the help of a authorized Counsel.
